Terms & Conditions

These Terms & Conditions apply to all agreements entered into with Atelier Smeijsters, insofar as the parties have not deviated from the terms expressly and in writing. 

 

The provisions of these terms and conditions of sale may only be deviated from if expressly agreed in writing, in which case the other provisions of these terms and conditions shall remain in full force. 

 

Atelier Smeijsters reserves the right to change or complement these conditions from time to time.

1. Copyright protection 

Atelier Smeijsters produces a high-quality collection of jewellery under its own name. All jewellery produced under the name of Hidde Smeijsters is protected by national and international laws (such as intellectual rights) and belong to Atelier Smeijsters. It is forbidden to reproduce, alter, make public, distribute or sell the name Hidde Smeijsters and/or jewellery made under the name Hidde Smeijsters.  

 

2. Errors and omissions 

The information, images and price indications shown on the website regarding the characteristics of the products are displayed as accurately as possible. Atelier Smeijsters cannot be held responsible for any errors, mistakes and/or incorrect information displayed on the website.  

 

3. Right of withdrawal/exchange 

Jewellery and ornaments from Atelier Smeijsters are custom-made products. These cannot be exchanged or returned.  
 

4. Privacy 

Atelier Smeijsters respects the privacy of all users of its site and ensures that the personal information you provide is treated confidentially. See the Privacy Statement. 

 

5. Use of Google Analytics  

This website uses Google Analytics. Google Analytics uses "cookies" to analyse the browsing behaviour of users on our website. See the Privacy Statement. 

 

6. Quotation/payment obligations 
Atelier Smeijsters offers customers a non-binding quote. If you agree to the order, a down payment of 40 to 50 per cent of the total amount will be required. Unless agreed otherwise in writing, the remaining amount shall be paid immediately or at the latest within 7 days after delivery.  
 
If the consumer does not pay within the agreed period, he/she is legally in default. In this case Atelier Smeijsters is entitled to suspend performance or to dissolve the agreement. The consumer also owes the extrajudicial and judicial costs.  

 

7. VAT-free purchase (outside the EU)  

Atelier Smeijsters offers customers the opportunity to purchase jewellery VAT-free. In the case of a VAT-free purchase, customers pay the Dutch VAT (21%) when purchasing the jewellery. This VAT is refunded when the jewel is exported to a country outside the EU. 

When checked by customs at an exporting European airport, you will need the following: 

1. The purchased product + purchase invoice of this product:  

The purchase invoice must be stamped by customs in the European exporting airport in order for the VAT to be reclaimed from Atelier Smeijsters. 

2. Passport: 

The customer must be in possession of a passport proving that the person is a non-EU resident. 

3. A boarding ticket: 

The customer must be in possession of an airline ticket showing that the person will be leaving the EU. 

The export must take place within 3 months after the purchase/invoice date. 

The VAT refund will only be carried out by Atelier Smeijsters after receipt of the purchase invoice (mentioning the purchased product), which has been stamped by the customs in the European exporting airport. 

The returned stamped invoice must be received by Atelier Smeijsters at the latest 2 months after stamping. 

Refunds can only be made if Atelier Smeijsters has clearly received the customer's IBAN account number and BIC or SWIFT code. 

The reimbursement is determined by the Dutch Chamber of Commerce, according to the legal European regulations. 
These regulations confirm that the invoice of the purchased product is sufficient for customs control. According to Dutch and European legislation, no other document is necessary. 

Atelier Smeijsters is not liable for anything that would prevent customers from exercising their right to VAT-free purchases. 

(E.g. loss of the stamped invoice by the customer, a closed customs office which makes it impossible to obtain a stamp, receipt of an incorrect account number by the customer, etc.) 

Unless Atelier Smeijsters is obliged to do so, all import and export duties or other local taxes are for the account of the client. 

 

8. Certificates/Quality  

Atelier Smeijsters only processes high-quality materials and diamonds, respecting both people and the environment. The precious metals of the Firma Schöne/Umicore consists mainly of recycled material. This supplier complies with certifications such as RJC and LBMA and strives to treat people and the environment as fairly as possible.  

 

The diamonds used by Atelier Smeijsters are standard VVS F/G and comply with the Kimberley Certification. The Kimberley Process is an international partnership for self-regulation between countries, non-governmental organisations (NGOs) and the diamond industry to eliminate conflict diamonds from the international diamond trade.  

 

9. Warranty 

All jewels are handcrafted and checked during the production process by Atelier Smeijsters. It is advisable to have your jewellery appraised annually by Atelier Smeijsters so that we can provide repair recommendations. If the recommended repairs are not carried out or carried out by parties not approved by Atelier Smeijsters, the warranty will be voided. Atelier Smeijsters is not responsible for damaged jewels due to wear or repairs and adjustments by third parties.  

In order to make use of the warranty, the customer must be able to present proof of purchase. Customers are advised to keep the original packaging. The warranty never applies to defects caused by accidents, abnormal or incorrect use, use of the item contrary to the purpose for which it was designed, alterations or modifications to the item, rough use, poor maintenance, or any other abnormal or incorrect use. The warranty does not apply to articles with a shorter lifespan or articles that are subject to wear and tear. Defects that become apparent after a period of 12 months following the date of purchase shall be deemed not to be hidden defects, subject to evidence to the contrary from the customer. 

Warranty is non-transferable. 

 

 

10. Complaints 

Atelier Smeijsters explicitly asks customers to carefully inspect the purchased products immediately upon receipt. Complaints from the customer regarding defects in the product that are visible on the outside must be reported by the customer immediately upon delivery. Trust and honesty are the foundation of this profession. Atelier Smeijsters strives to resolve any complaints properly. 

In the event that a complaint is not settled to the satisfaction of the customer, Dutch law shall apply.
